Webcast Outlining FCRA and Background Checks for HR Professionals Scheduled for September 26

Ory Tucker, the Client Experience Director of Employment Screening Resources® (ESR), will present a live webcast titled ‘The Federal Fair Credit Reporting Act (FCRA) and Background Checks’ for the HR.com Institutes for Human Resources (IHR) Quality of Hire Virtual Conference on Thursday, September 26, 2013 from 2:30 PM to 3:30 PM ET. During the webcast, Tucker will provide a basic overview of the FCRA – the federal law that governs background checks – and cover the primary obligations of employers including the requirements for an employer certification, authorization for a background check, disclosures to the consumer, the concept of a “permissible” purpose, and information prohibited under the FCRA. She will also explain what to do when a negative background check is returned from a screening firm and the “adverse action” process.

Participants in this webcast for Human Resources Professionals, Recruiters, and Hiring Managers will:

  • Learn why knowledge of the federal FCRA and similar state laws is critical in the hiring process.
  • Learn the four basic steps needed for compliance with the FCRA.
  • Understand how the FCRA protects consumers and what an employer must do when a consumer disputes a background check report.

Other important topics covered in the webcast will include an applicant’s right to a re-investigation, how to handle a situation where an applicant maintains a background report is incomplete or inaccurate, and how to handle the investigation of a current employee. The session will also review other critical aspects of the FCRA including accuracy requirements, penalties for negligent or willful violation of the law, how state laws may add additional obligations, and how the FCRA may apply to social media searches.

To avoid bad hiring decisions, employers have increasingly turned to pre-employment background screening as a risk management tool. However, no screening program can be conducted without a full understanding of the FCRA. The failure to understand and follow the FCRA can result in expensive and time consuming litigation with businesses paying multi-million dollar settlements. Employers that do not take the time to fully comply with the FCRA could well find themselves risking extensive litigation.
